Last Updated: February 7, 2026
These Terms and Conditions ("Terms") govern your use of the Lullaby mobile application (the "App") provided by Superposition LLC ("Superposition," "we," "us," or "our"). By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1) Who We Are
Owner: Superposition LLC
Jurisdiction / Governing Law: State of South Carolina, USA (see Section 14)
2) Eligibility and Intended Users
The App is intended for use by adults (for example, parents, guardians, and caregivers) to help track and organize information related to infant or child care.
- You must be at least 18 years old, or the age of majority where you live, to use the App.
- The App is not intended to be used by children on their own. You may store information about a child if you are the parent/guardian or otherwise legally authorized to do so.
3) No Medical Advice
The App is provided for informational and organizational purposes only.
- Superposition is not a healthcare provider.
- The App does not provide medical advice, diagnosis, treatment, or clinical recommendations.
- Nothing in the App is a substitute for professional judgment or decision-making.
- If you have questions about health or medical concerns, you are responsible for obtaining appropriate guidance from qualified professionals.
4) Your Responsibilities
You are responsible for:
- Ensuring the information you enter is accurate and appropriate for your purposes.
- How you interpret and use any outputs, summaries, reminders, or insights shown in the App.
- Maintaining the confidentiality of your device access (including passcodes, biometrics, and Apple ID security).
- Complying with all applicable laws and regulations.
5) Acceptable Use
You agree not to:
- Use the App for unlawful purposes.
- Interfere with or disrupt the App, its security, or related systems.
- Attempt to reverse engineer, decompile, or extract source code except where allowed by law.
- Use the App in a way that could harm others, violate privacy rights, or misuse personal data.
6) Privacy
Your use of the App is also subject to our Privacy Policy, which describes how information is handled. The Privacy Policy is incorporated into these Terms by reference.
If there is a conflict between these Terms and the Privacy Policy, these Terms control with respect to App use rules, and the Privacy Policy controls with respect to data handling.
7) Subscription, Free Trial, Billing, and Cancellation (Apple App Store)
7.1 In-App Purchases via Apple
Paid features are offered through an auto-renewing subscription processed by the Apple App Store.
- We do not process payments and do not store credit card or payment account information.
- Any billing questions, receipts, payment methods, or refunds are handled through Apple under Apple's terms and policies.
7.2 Pricing and Trial
- The subscription is $4.99 per month after a 7-day free trial, unless you cancel before the trial ends.
- Pricing may vary by region and may change if Apple changes pricing tiers or taxes; the price shown in the App Store at the time of purchase controls.
7.3 Automatic Renewal
Unless you cancel, your subscription will automatically renew at the end of each billing period, and Apple will charge your Apple ID account under Apple's applicable rules.
7.4 How to Cancel
You can cancel at any time through your Apple ID subscription settings (in the App Store or device settings). Cancellation stops future renewals, but access may continue until the end of the current billing period, depending on Apple's policies.
7.5 Refunds
Refund requests (if available) are handled by Apple, not Superposition.
8) Intellectual Property
The App and all related content, design, logos, and software are owned by Superposition or its licensors and are protected by intellectual property laws.
- We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use in accordance with these Terms.
- You may not copy, modify, distribute, sell, lease, or create derivative works from the App except as allowed by law.
9) User Content
"User Content" includes information you enter into the App (such as notes, logs, and entries).
- As between you and Superposition, you retain ownership of your User Content.
- You grant Superposition a limited license to use, process, and display your User Content solely to operate and provide the App's functionality (and to maintain, troubleshoot, and improve it).
- You represent you have the rights and permissions necessary to provide any User Content you enter, including information about a child.
10) No Guarantees; Disclaimer of Warranties
The App is provided "as is" and "as available." To the maximum extent permitted by law:
- We make no warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, or non-infringement.
- We do not guarantee the App will be uninterrupted, error-free, secure, or compatible with your device.
- We do not guarantee that reminders, tracking, analytics, or outputs will be correct or suitable for your use.
11) Limitation of Liability
To the maximum extent permitted by law:
- Superposition will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or business interruption, arising from or related to your use of (or inability to use) the App.
- Superposition is not responsible for misuse of the App or for decisions you make based on information you enter or view in the App.
- Superposition's total liability for any claim arising out of or relating to the App or these Terms will not exceed the greater of:
1) the total amount you paid to Superposition (through Apple) for the App subscription in the 12 months before the event giving rise to the claim, or
2) $50 USD.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12) Indemnification
You agree to defend, indemnify, and hold harmless Superposition LLC and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the App
- Your violation of these Terms
- Your User Content, including any claim that you lacked rights or permissions to provide it
- Your violation of any law or third-party rights (including privacy rights)
13) Changes to the App or These Terms
We may update the App and may modify these Terms from time to time.
- If we make material changes, we may provide notice in the App or by other reasonable means.
- Continued use of the App after changes become effective means you accept the updated Terms.
14) Governing Law; Venue
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules.
Unless prohibited by applicable law, you agree that any dispute arising out of or relating to these Terms or the App will be brought in the state or federal courts located in South Carolina, and you consent to their jurisdiction and venue.
15) Termination
We may suspend or terminate your access to the App if you violate these Terms or if required to do so for legal or security reasons. You may stop using the App at any time. Subscription cancellation is handled through Apple (see Section 7).
16) Third-Party Services and Apple-Specific Terms
16.1 Third-Party Services
The App may rely on third-party services (such as Apple services, device operating system features, or analytics/crash reporting if enabled). We are not responsible for third-party services or their actions.
16.2 Apple App Store Acknowledgements
If you downloaded the App from the Apple App Store:
- These Terms are between you and Superposition, not Apple.
- Apple has no obligation to provide maintenance or support services for the App.
- Apple is not responsible for addressing claims relating to the App, including product liability, consumer protection, or intellectual property claims.
- To the extent any warranty exists that is not effectively disclaimed, Apple is not responsible for that warranty, and any claim is limited as permitted by applicable law.
- You agree to comply with applicable App Store rules and terms.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17) Severability; Entire Agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms (together with the Privacy Policy) are the entire agreement between you and Superposition regarding the App.
